We spotted this sign this morning at Miami-Dade College near the Seven50 Summit. What’s wrong with this picture?
The sidewalk on the left is open and was filled with students so much that the two in the picture were overflowing onto the street.
On October 30th, a dramatic crash caused by a careless motorist sent a parked SUV flying 30 feet and onto the sidewalk, seriously injuring the ankle and leg of Monica Larcada, a female jogger that lives in the neighborhood.
Transit Miami has obtained a complete copy of the police report from the Miami Police Department regarding this crash.
The driver of the vehicle causing the crash was Dr. Amy Buchman, 60, of Brickell Key. She was cited for careless driving – failure to maintain control of vehicle.
What is bewildering is that the police report says her estimated speed was 25 miles per hour, though multiple witnesses to Transit Miami report she was moving closer to 40-50 mph in the 30mph zone. The parked Nissan Murano SUV that Buchman smashed into traveled about 30 feet, indicating a much higher speed than 25 mph.
Felipe Larcada, Monica’s father, wrote the below note to us in November. If you have any information on this crash, please contact him. The area has been the scene of eerily similar crashes over the past few years.
Monica is doing better every day and hopefully will have her stitches removed this week and a cast placed on her leg. Thank you all for your concern and prayers.

I’ve spoken with Felipe and we are in the process of obtaining the police report from the crash. Monica has a serious ankle injury from the tire of the parked SUV that hurtled onto the sidewalk. We have some information about the driver of the vehicle that caused the crash, but will wait until we have the police report to post about it.

Last week, Bill C., posted the following comment on Transit Miami.
“People should ignore the Bal Harbour rule because it is unlawful. Your right to operate your bike on the sidewalk is a right protected by state statute.”
He goes on to say:
“Section 316.2065 (10), Florida Statutes, expressly provides that “A person propelling a vehicle by human power upon and along a sidewalk, or across a roadway upon and along a crosswalk, has all the rights and duties applicable to a pedestrian under the same circumstances.”
“It is well established under Florida law that municipalities cannot remove rights granted by state statute. In Rinzler v. Carson, the Florida Supreme Court declared:
Municipal ordinances are inferior in stature and subordinate to the laws of the state. Accordingly, an ordinance must not conflict with any controlling provision of a state statute, and if any doubt exists as to the extent of a power attempted to be exercised which may affect the operation of a state statute, the doubt is to be resolved against the ordinance and in favor of the statute. A municipality cannot forbid what the legislature has expressly licensed, authorized or required, nor may it authorize what the legislature has expressly forbidden. In order for a municipal ordinance to prohibit that which is allowed by the general laws of the state there must be an express legislative grant by the state to the municipality authorizing such prohibition.”“Bring the state statute to court with you if you get a ticket for riding on the sidewalk. Sue Bal Harbour if you get hit by a motor vehicle because you were following their illegal ordinance.”
We decided to check with the South Florida Bike Coalition legal team and they agree; the Bal Harbour ordinance is in conflict with the State statue.
We here at Transit Miami do not advocate bicycling on sidewalks, but Bal Harbour is forcing inexperienced cyclists to ride on dangerous Collins Avenue. I would not want my child riding on Collins Avenue. Bal Harbour should not force people to ride in the roadway. Rather then castigating cyclists Bal Harbour should work with the FDOT to provide a safer environment for cyclists of all ages to ride comfortably and safely through Bal Harbour.
How about a group ride up and down the sidewalks of Bal Harbour?

These pictures were taken yesterday in front of the 200 South Biscayne Boulevard building. Cars have always parked here illegally to pickup passengers. So in order to accommodate the cars, approximately 4 feet of sidewalk has been taken away from pedestrians. Pedestrians are now only left with about 4 feet of sidewalk.
Sorry, but I want the sidewalk back. One of the most used Metro Mover stations is less than a block away. There is enough density in this area to justify an 8 foot sidewalk.
